EU weighs ban on Syria firms alongside oil embargo (Reuters)

BRUSSELS (Reuters) ? European Union governments may impose sanctions on Syrian banks as well as energy and telecommunications companies within a week, along with a planned embargo on oil imports from the country, EU diplomats said on Monday.

The EU's 27 governments will hold a new round of talks on Tuesday on expanding sanctions against the government of President Bashar al-Assad, aimed at pressuring him to halt a crackdown on anti-government protesters and relinquish power.

They will weigh proposals for a ban on EU citizens doing business with firms that support him. Such prohibitions could be introduced together with the oil embargo which has already won preliminary backing of all EU governments in recent days and awaits final approval this week, diplomats said.

"Some EU member states are doubtful when it comes to specific companies but it is possible to see entities from the banking, telecommunications and energy sectors already in this round of sanctions," one EU diplomat said, speaking on condition of anonymity.

Disagreements have persisted in the EU over proposals to ban citizens from investing in the Syrian oil industry in general and to prohibit exports of oil-related equipment to Syria.

These could delay the plans to add major Syrian companies to the lists of banned entities. But diplomats said there was a push to have at least the oil embargo agreed before an informal meeting of EU foreign ministers in Poland Friday and Saturday.

"There is a strong sense of urgency that the decision should be ready before that," one diplomat said.

The new measures, particularly the oil embargo, are a significant step for the EU, which until now has taken an incremental approach to imposing sanctions on Syria because of concerns in some EU capitals about the risks to their commercial interests.

The United States has already introduced an oil embargo and a ban on investment in Syria, where the United Nations says 2,200 people have died during violence.

Diplomats say EU capitals are now showing more urgency in preparing new measures. The EU has no broad economic sanctions yet, only travel bans against officials in Assad's inner circle and asset freezes imposed against several government entities and military-linked firms tied to the crackdown.

An EU ban on Syrian crude would have a significant impact on Assad's access to foreign currency, because European countries import most of the crude that Syria sells abroad.

Nearly 900,000 lose power as Irene moves north (AP)

Nearly 900,000 homes and businesses lost power as Hurricane Irene slammed into the East Coast. A million or more could be in the dark by Saturday night as the storm charges north.

Winds of up to 115 miles per hour whipped across the Eastern Seaboard, ripping power lines from poles and snapping trees in half. Hospitals, emergency call centers and other crucial facilities were holding up, but officials said it could get much worse as Irene churns north.

Gasoline supplies were falling as drivers fill up before leaving town or just top off their tanks as a precaution before the storm hits. Pump prices rose about 3 cents per gallon overnight in New Jersey and Pennsylvania.

So far, the power losses were concentrated in Virginia and North Carolina, where Irene charged ashore early Saturday morning. Thousands more are expected as the storm moves up the heavily populated Interstate 95 corridor.

Dominion Resources reported outages for 598,000 of its customers in Virginia and North Carolina, while Progress Energy reported 263,000 customers without power, with much of the damage in Wilmington and Wrightsville Beach, N.C.

"We expect those numbers to increase," Progress spokeswoman Julia Milstead said.

Duke Energy said 13,800 customers were in the dark. Pepco, which serves Maryland, Washington D.C., parts of New Jersey and Delaware reported nearly 14,000 outages. Baltimore Gas & Electric said 9,000 of its customers were without power.

New York's biggest utility, Consolidated Edison, said it could cut power to the city's most vulnerable areas if the storm causes serious flooding. Salt water and rain can damage electrical equipment.

ConEd operations chief John Miksad said the utility doesn't expect to cut power before the storm hits, but flooding Sunday could bring a shutdown to areas including the southern tip of Manhattan. That would cut off power to major Wall Street institutions through parts of next week.

The New York Stock Exchange has backup generators and can run on its own, a spokesman said Friday. The exchange expects to open as usual Monday morning, though it may change plans depending on the severity of the storm.

New York is regularly blasted by winter storms, but Miksad said this hurricane will be different. Irene's wind will pack a stronger punch than a nor'easter last March that knocked out power to 175,000 customers, he said.

ConEd has called in crews from as far as Colorado to help repair damage from the storm.

Irene is expected to be a brutal test for Middle Atlantic States, which haven't seen a hurricane since 1999. The storm is expected to stay just offshore ? and thus retain much of its power ? as it inches up the coast from North Carolina to New England. When a hurricane hits land, wind speeds diminish.

The entire Eastern Seaboard lies in the storm's projected path. Flooding and damage from winds are likely. North Carolina, Virginia, Maryland, New Jersey, New York, Connecticut and Rhode Island have declared emergencies. For the first time, New York City ordered people in low-lying areas to evacuate.

Power companies have called in several hundred workers from surrounding states to help. Crews were rushing out between bands in the hurricane, when the wind and rain ease. They're looking for damage first at towering transmission lines, where an outage could put an entire county in the dark.

The storm has already caused gasoline supplies to fall as refueling barges wait out the storm off the coast. Widespread power outages could lead to fuel shortages as gas stations are no longer able to pump gas or have trouble replenishing their own gas supplies.

"Power is the lifeblood of oil supply on the East Coast," said Ben Brockwell of the Oil Price Information Service, which tracks gasoline shipments around the country.

Some gas stations in New Jersey reported that they'd run out of fuel. Those shortages could become more widespread.

Retail gas prices were mostly unchanged in many cities that are expected to be hit this weekend. Rules against price gouging at gas stations took effect throughout Middle Atlantic states. Authorities will be looking for stations that try to take advantage of panicked drivers.

Pump prices were up slightly overnight, as much as 3 cents per gallon, to $3.44 in Philadelphia and $3.49 in New Jersey's Atlantic-Cape May metro area. They seemed to hold in other areas, rising a penny or so on average in Maryland, Virginia and the Carolinas.

The Colonial Pipeline, which transports gasoline and other fuels from the Gulf Coast to the Northeast, stopped fuel deliveries to Selma, N.C., and to Virginia's Tidewater area as the storm knocked out power. Pipeline spokesman Steve Baker said the pipeline may cut off deliveries further in Virginia and Maryland as the storm moves north.

Refineries, which make fuel from oil, have started to slow operations as Irene approaches.

OPIS says East Coast refineries will cut operating rates 10 percent to 25 percent in the next few days. Refineries in the Gulf Coast and the West should be able to keep supplies flowing to the rest of the country.

Refineries along the Louisiana Coast produce more than three times the gasoline and fuel of their East Coast counterparts, according to the Energy Information Administration. East Coast demand is going to fall as businesses close and people hunker down at home.

(AP) ? The Emmental Show Dairy has cranked out tons of cheese for years. But now it's in trouble ? production is down by a third and the company fears it may be forced to cut back to just a few wheels a day, enough to show tourists.

The dramatic slide in sales of Emmental, popularly known as "Swiss cheese" in North America, is caused by the strength of the Swiss franc, a financial phenomenon that is driving down profits in sectors across all of export-driven Switzerland.

Adrian Zehnder, the dairy's business manager, says the company is earning 5.49 Swiss francs ($6.92) per kilo, down from 7.80 francs per kilo last year. Most of the cheese is exported to Europe, mainly Italy.

"We are really coming close to our break-even point, which is around 5.30 francs. Then we really have to think about stopping our production," Zehnder said, on the rolling green hills in central Switzerland where cows graze within view of the snow-flecked Bernese Alps.

Swiss government officials are well aware of the problems that exporters like Zehnder's dairy are facing.

The country's currency is used by international investors as a safe haven in times of trouble. When global stock markets are volatile and vulnerable, as they have been lately, traders like to park their capital in Swiss money accounts.

On top of that, the Swiss economy has been doing better than many nations in Europe, where the debt crisis has shaken the financial sector and forced governments to cut spending.

As a result, the Swiss franc rallied from buying 76 euro cents in April to 97 euro cents in early August. On Thursday, it traded at 87 euro cents. Against the dollar, it rose from $1.02 at the start of the year to buy as much as $1.39 this summer.

"It's kind of a paradox. We have a situation where we are suffering because the Swiss economy is strong," government spokesman Andre Simonazzi said.

He declined, however, to consider the possibility that the franc could cause a contraction in Switzerland's economy. "We are not making plans and talking of recession."

The export-reliant economy is still chugging away at a healthy 2.4 percent growth rate. It exported 16.6 billion francs ($20.9 billion) worth of goods in July, up 3 percent on the month.

But the inexorable rise in the franc threatens to reverse the country's economic fortunes. Because of "the flight of the franc" hitting exports, the Swiss government says it now expects a slowdown in the nation's growth to 2.1 percent for 2011, and to 1.5 percent in 2012.

UniCredit Bank AG economist Alexander Koch wrote in a report that there's "already a probability of around 50 percent for a recession at the end of this year."

None of a series of recent measures by the Swiss National Bank and the country's governing Federal Council has put a dent in the franc's value. The government plans to inject $2 billion francs into the economy, which would have the effect of diluting the value of the franc.

But Koch said that is not nearly enough. Meanwhile, negative news from the eurozone debt crisis can drive the franc up any time.

"We therefore believe that an at least drastic slowdown of the Swiss economy is in the cards," he wrote. "Switzerland is on the brink of recession."

European neighbors ? struggling with massive national debts that have eroded confidence in their ability to repay their government debt ? are seeing a slide in consumer spending. Italians and Spaniards are buying less Swiss cheese and chocolate as public sector salaries are trimmed and pension pots shrunk.

Zehnder said cheese makers usually try to boost production to keep their income up when prices fall. But that's led to a glut of Emmental on the market these days, adding to the downward price pressure.

He would rather see the exchange rate fixed between the muscular franc and the battered euro ? a move that is increasingly gaining favor among policymakers.

"We will not shut down our company," he said of the 100-employee cheese-producing dairy, restaurant and store. "We would run the tourist and restaurant parts, but definitely we would think about dropping the production to zero, and we would go for three or four wheels a day, just for tourist purposes, and show the guests how Emmental used to be made."

Place fresh-cut flowers in a simple vase and use your best tablecloth and matching cloth napkins for best effect.

The Problems with Patent Reform

Patent reform is about to negotiate the final hurdle standing between it and President Obama?s desk, where it would almost certainly be signed into law. The hurdle is a Senate cloture vote scheduled for September 6. The patent reform bill ? which these days goes by the friendly name of the ?Leahy-Smith America Invents Act? ? has already passed the House; clearing the Senate cloture vote pretty much guarantees passage and enactment.

As the White House and lawmakers from both sides of the aisle tell it, passage will work economic wonders for all Americans: the bill will ?boost patent quality, reduce the backlog of patent applications, and cut costs for American companies? by ?provid[ing] greater certainty and consistency for innovators? rights,? reducing legal costs on small businesses, and helping innovators commercialize their inventions, ultimately ?cut[ting] the red tape that . . . holds our whole economy back.? Indeed, as soon as Congress sends the bill to the President, it will be ?easier for entrepreneurs to patent a new product or idea ?- because we can?t give innovators in other countries a big leg up when it comes to opening new businesses and creating new jobs.?

You may recall that similar legislation has been proposed for at least the last six years; however, 2011 is the first year that patent reform will allegedly ?boost the economy? or ?create jobs.? What in the 2011 legislation is newly geared at invention commercialization and economic growth through patent reform?

Nothing, as it turns out. Instead, as several non-politician commentators have pointed out, many provisions newly stuffed into the current bill are certain to have a negative impact on patent examination backlog while failing to address other real problems with the patent system, suggesting that those praising the bill are either not paying attention to its contents or are simply desperate to pass anything branded under ?job growth? or ?reform? in a legislative system that is largely perceived as dysfunctional.

This opinion piece takes a closer look at three problems ? stripping of USPTO funding, unique anti-patent treatment for the financial sector, and prior user rights that undermine technological disclosure ? with the Leahy-Smith America Invents Act now before the Senate. An examination of the substance and process of the legislation shows no red tape will be cut by, and few inventions sped to market by, the reforms, which instead reflect more partisan point scoring and special interest catering than effort to reduce patent backlog and increase patent quality and job creation.

First up is the most tragic provision of the America Invents Act ? Section 22, which limits how much the USPTO can use its own fees. That is, Section 22 permits Congress to take the money the USPTO earns from providing services to applicants and divert the funds to non-USPTO projects. The practice, termed ?fee-diversion,? has been ongoing and resulted in cuts to USPTO services, as the USPTO Director himself has stated, including limiting new Examiner hiring and acquisition of new IT infrastructure that would help combat the growing patent backlog.

The Senate originally passed their version of a patent reform bill (S.23) in March 2011 by a 95-5 bipartisan vote. S.23 guaranteed the USPTO could keep and plan around all the user fees it collects, thanks in large part to the efforts of Senator Tom Coburn (R-OK). The House, however, in an effort spearheaded by Reps. Paul Ryan (R-WI) and Harold Rogers (R-KY), reversed this benefit. The House version currently awaiting Senate approval includes a new Section 22, which permits Congress to take excess USPTO funding from a special fund and spend it elsewhere. While Representative Rogers stated that excess USPTO funds will be spent only on the USPTO, the actual language of Section 22, in addition to the pressure from the new debt-ceiling committee to squeeze all excess revenues into the general treasury, does not give the USPTO any certainty as to what funding will be available in coming fiscal years. Additionally, the fee diversion of Section 22 undermines any fee-setting authority given to the USPTO; the USPTO cannot set fees to recover USPTO expenses if those fees are appropriated by Congressional third-parties to cover other government expenses. (It?s worth noting that the House also added a sunset provision to the USPTO fee-setting authority, so it will go away in seven years anyway.)

So all the exhortations that the patent reform bill will speed inventions to market by reducing the patent backlog are almost certainly false, at least to the degree that such backlog might be addressed with additional USPTO funding. Without being able to hire additional Examiners or make long-term decisions based on long-term funding, the Office will have few tools to improve patent quality and reduce the nearly 700,000 application backlog (it currently takes the Office over 2 years to act on an application filed today). As a frequent user and customer, I find that USPTO operations are already in a precarious state. Continuing fee diversion, under Section 22 of the America Invents Act, will only worsen this situation by preventing the USPTO from making long-term plans or funding initiatives to meet the demands of American innovation like reducing the examination backlog.

Next up, provisions doling out benefits to the special interest of the day: banks. Sections 14 and 18 of the America Invents Act establish special anti-patent treatment of inventions on tax strategies and pure business/financial services methods. In a special-interest coup for the bank lobby, Senator Charles Schumer (D-NY) added provisions to the bill that invalidate entire swaths of tax strategy patents and provide a unique procedure to tie up patents asserted against their business models in new USPTO post-grant review. The only reason these narrow areas of innovation are undeserving of patent protection is because established financial service entities don?t want to pay licensing fees or damages due to patents their businesses infringe. The financial servicers would rather use the patented tax strategy, check-processing method, stock-transfer mechanism, or what-have-you without the person who came up with the strategy/method/mechanism getting any cut of the profits or potentially entering the market and upsetting established market shares with disruptive innovation. Of course, financial services innovation will quickly disappear altogether when the patent system cannot protect or reward it, which is likely exactly what the lobbying financial servicers want.

As former Federal Circuit Judge Paul Michel and IP commentator Hal Wegner have noted (and received criticism from the banking lobby for so noting), given the mechanisms and (lack of) reasoning for Congress?s special treatment of the financial service industry, it?s unclear why US lawmakers, or even foreign lawmaking bodies, will not identify and exclude other industries from patent protection on disruptive innovation, so long as those industries lobby Congress hard enough. Maybe China will decide that pharmaceutical methods are not a patent-worthy industry, and this just happens to result in all US-invented drug treatments having no patent rights in their country? Indeed, the fact that only financial services patents were given the axe in the America Invents Act, despite long-standing outcry against software patenting in this country, suggests that the anti-software patent voices just need to start playing donation hardball with influential senators to get software patents similarly invalidated or caught up in endless review before the USPTO.

Particularly worse is the combination of post-grant reviews (plural ? as in multiple administrative procedures) of Sections 18 and 6 of the patent reform bill, which increase the complexity of post-issue procedures before the USPTO to a mega-bureaucratic and almost byzantine level. Professor John Duffy makes this point better than I ever could. It?s probably even worse than Professor Duffy admits, because the post-grant review procedures are not clearly delineated in their application ? they simply permit post-grant review for ?non-technological inventions,? as decided by the USPTO Director. So what is a ?technological financial? product or service? Checks with anti-counterfeit technology in them? Stock trading methods that rely on computerized trading technology? Methods of hedging risks in an e-commerce commodity market? Only the current USPTO director knows! As a patent attorney, I can?t help but admire Sections 6 and 18 for the increased work and revenue they will generate in the near term for my profession. But keep in mind, this is a bill that is supposed to ?cut the red tape? and ease USPTO examination burdens. I can?t see how the creation of several new overlapping procedures for the USPTO to deal with an ambiguous class of patents it has already issued will help streamline USPTO operations. Maybe in the long-term, Sections 6 and 18 will reduce USPTO burdens, as innovators come to realize the price of dealing with these many post-grant proceedings and stop filing patents and disclosing their innovations?

Lastly, Section 5 of the America Invents Act creates a blanket defense to patent infringement for prior, secret users of a patented invention. Basically, so long as a party secretly uses an invention ?commercially? (even one use will apparently do), they are protected from ever infringing a third party?s later patent on that invention. That is, the party that uses and keeps as many trade secrets as possible can be assured individual benefit from the trade secrets without any risk of infringement if a third party manages to later replicate and patent (and thus disclose) their trade secret. This is horribly detrimental to an underlying policy goal of the patent system ? disclosure of scientific breakthroughs and technological advances. Under Section 5, an innovator has no motivation to come forward with any inventive process, because they have a patent infringement defense if a third party later patents such a process. Under current law, anyone maintaining a trade secret indefinitely runs the risk of infringing a third party?s later patent on that secret. Section 5 eliminates this risk; a manufacturer that believes they can maintain trade secrets indefinitely, such as in the case of a highly-specialized field, in extremely advanced breakthroughs, or when no competitors are seeking patent protection, faces no risk under the current patent reform bill. The result will inevitably be greater universal trade secret activity, with fewer advanced manufacturing and fabrication processes being disclosed for patent protection, entire industries potentially falling into guild-like secretive societies, and entry costs into highly advanced technology sectors greatly increasing.

Worse, (and I apologize that this paragraph is getting very ?inside baseball?) Sections 2 and 5 of the reform bill, together, potentially reverse Metalizing Engineering. The Metalizing doctrine prevents a party who commercially benefits from their trade secret from later patenting that trade secret, while allowing third parties to independently invent and patent (and thus disclose) the trade secret. Section 2, with its generic use of the term ?disclosure,? may permit the trade secret user to later patent that trade secret (despite Senator Leahy?s thinking to the contrary), while defeating any third-party ability to ensnare the trade-secret keeper in infringement. The net result of patent reform will inevitably be greater trade secret use and less public disclosure of technological advances; it is just a question of to what lengths and risks industries will go to effectively keep trade secrets. I can?t begin to guess how this is going to spur innovation and boost our economy.

To be sure, the America Invents Act includes many neutral or good things for the patent system. The legislation removes the idiosyncratic ?best mode? requirement from the patent statute, removes restrictions on Federal Circuit judge?s residency, eases signature problems with non-cooperative inventors, supercedes the Supreme Court case of Holmes Group v. Vornado, permits USPTO fee-setting, addresses false-marking lawsuit abuse (and potential unconstitutionality), liberalizes third-party submission of information relevant to the examination process, and harmonizes US patent law with the rest of the world by switching the US from a ?first-to-invent? to a ?first-to-file? jurisdiction (albeit partially and ambiguously).

Sometimes one must take the bitter with the sweet in getting legislation passed. But the above acrid ingredients ? stripping of USPTO funding, special anti-patent treatment for the financial sector, and prior user rights that undermine technological disclosure ? overwhelm the patent reform cake with bitterness, leaving maybe a single sweet cherry on top. I urge all interested practitioners to oppose the America Invents Act currently awaiting a cloture vote in the Senate by contacting your Senator, signing the petition at reformaia.org, and contacting your advocacy groups like IPO and AIPLA.

Thanks Seth Godin! What you do is art.

In his book, Linchpin, Seth Godin writes, ?Art is a personal gift that changes the recipient. . . An artist is an individual who creates art. The more people you change, the more you change them, the more effective your art is.?? I adore this on so many levels. My heart in writing and speaking has always been in life transformation, about connection and change.

So the cool thing is, whatever you do, wherever you are, you can be an artist?one who enacts change in those you interact with. This makes a deep and real conversation art. This makes positive interaction with your customers art. This makes your dedication to excellence art. What you do is art if your heart is to see transformation.

So the question becomes, how can your life be art? How can you live and work in such a way that others change? What do you create that makes people stop, pause, and think? How have you shocked others (in a positive way) because of the creative way you view a solution?

This also means that any emotional homework you do translates to the field of your art. Seth continues:? ?Sometimes, though, caught up in the endless cycle of commerce, we forget about the gift nature of art, we fail to do the hard work of emotional labor, and we cease to be artists.?

In terms of writing, I?ve read my fair share of books that feel cookie cutter, where the author regurgitates things I?ve read before. The books that stun and woo me are the ones where the author has taken a long trip down an emotionally charged highway and dared to think/dream/write differently. I?ve often told my writing students, ?Great books flow from a great heart.? To create soul-stirring art, we must realize that we?re not copycatters. We are not simply purveyors of others? thoughts and hardwon truths.

To be artists is to dare to go there. To be real with ourselves. To welcome the barenaked realities of life, stare ourselves in the face, and seek God?s interaction in the midst of our world.

Even when I teach novel writing, I emphasize this fact. We can be safe storytellers, relying on convention and what?s been done before. Or we can examine ourselves, live life more fully engaged. That engaged life can?t help but spill onto the page. Or overflow into our work and life.

And as you deepen and improve your work, reward follows. Seth encourages, ?A day?s work is your chance to do art, to create a gift, to do something that matters. As your work gets better and your art becomes more important, competition for your gifts will increase and you?ll discover that you can be choosier about whom you give them to.?

Be encouraged today. Your art is bringing you to new places. Remember Proverbs 22:9: ?Do you see a man skillful in his work? He will stand before kings; he will not stand before obscure men.?

So persevere. Do the hard work. Give your art freely. Work as an artist wherever God has placed you. This world needs you.

Philippine rebel group ousts radical commander (AP)

MANILA, Philippines ? The Philippines' largest Muslim guerrilla group has ousted a radical commander who staged a mutiny and then formed a breakaway force with hundreds of fighters, a rebel leader said Sunday.

Vice Chairman Ghazali Jaafar of the Moro Islamic Liberation Front said his group approved a resolution last week dropping Ameril Umbra Kato from its membership after months of efforts to woo him and his fighters back failed.

Kato told The Associated Press last week that he has formed a new group to fight for a Muslim homeland.

Rebel negotiators will notify their Philippine government counterparts of Kato's removal when the two sides resume peace talks in Malaysia on Monday, Jaafar said.

Kato has about 200 to 300 fighters in the hinterlands of southern Maguindanao province, a stronghold of the main rebel force, Jaafar said. Asked how the rebels would deal with Kato and his men if they start creating trouble, Jaafar said his group has not made any definite plans.

The infighting within the main 11,000-strong rebel force underscores the complexity of the Muslim unrest that has claimed more than 120,000 lives and stunted growth in the impoverished but resource-rich south of the predominantly Roman Catholic Philippines.

Philippine officials have expressed concern over the infighting, which they say casts doubts about the main rebel group's ability to enforce any future accord in the peace talks brokered by Malaysia.

President Benigno Aquino III said the rebels have acknowledged the infighting and could seek help from the military. But if Kato launches attacks, government troops would have to take steps to protect communities, he said.

Kato, who is in his late 60s, said last week that he left because the main rebel group chose to "waste time" by deciding to negotiate with the government for expanded autonomy instead of fighting for an independent homeland that would liberate minority Muslims from crushing poverty and neglect.

Security officials have accused Kato in the past of providing refuge to members of the Southeast Asian militant network Jemaah Islamiyah, the small but brutal Abu Sayyaf group and Filipino militants. They include Usman Basit, who has been sought by U.S. and Philippine authorities in connection with deadly bomb attacks.

Kato said he and his men lead honorable lives and are ready to die for their convictions if they come under attack. He condemned groups like the Abu Sayyaf, which he described as bandits "who exist for money and engage in forbidden business."

More volatility ahead as uncertainty rules (Reuters)

NEW YORK (Reuters) ? The historic swings in the U.S. stock market over the past two weeks have investors struggling to figure out where equities may be headed next. Only one thing seems clear: The volatility is far from over.

A lack of progress on some of the economy's biggest issues -- from sovereign debt in Europe to growing signs the U.S. economy is in danger of slipping back into recession -- will drive more uncertainty and moves from one extreme to another.

However, with the S&P 500 down 17.6 percent from its 2011 high, many investors say a bottom could be near and bargain hunters could trigger at least a momentary bout of buying.

"We're not even close to the end of volatility, but given a decline of almost 17 percent in 13 days, we could see a rise from these levels," said Mike Gibbs, chief market strategist at Morgan Keegan in Memphis, Tennessee.

"If there's something major with the European situation, that could be a catalyst for value investors to come back in."

The situation in Europe has been dictating much of the market's recent movement. On Tuesday, shares fell after a meeting between the heads of France and Germany failed to squelch fears about euro-zone leaders' ability to contain the region's debt issues, which could impact global growth and the profit outlooks of U.S. banks.

Market participants will also be looking ahead to comments from Federal Reserve Chairman Ben Bernanke at the central bank's annual meeting in Jackson Hole, Wyoming, on Friday.

The Fed recently pledged to keep interest rates "exceptionally low ... at least through mid-2013," news that sparked a short-lived rally, suggesting that there may be little new information coming out of the Jackson Hole meeting that could move markets.

"There's nothing Bernanke can do that's likely that will help stocks," said Matt McCormick, a money manager at Cincinnati-based Bahl & Gaynor Inc, which has $3.2 billion in assets under management.

"If you see potential bank problems out of Europe before then, he might have some ammo for another round of quantitative easing, but absent that, investors hoping for an August surprise will likely be disappointed."

AN ATTRACTIVE YIELD

The S&P 500 fell 4.7 percent this week, extending losses of 12.4 percent over the previous three weeks, its worst streak of that length in 2-1/2 years.

The CBOE Volatility Index (.VIX), also known as the VIX, is up 20 percent this week.

In a note, Birinyi Associates wrote that while the market remained difficult in the short term, there were indications that stocks were attractively valued.

Noting that the S&P 500 was 10 percent below its 50-day moving average, Birinyi said, "This is the most oversold the market has been" since March 2009.

Birinyi pointed out that the 2.25 percent dividend yield on the S&P 500 was higher than the 10-year U.S. Treasury note's yield, making this "only the second period since the 1950s where stocks have yielded more than bonds."

DOING THE EUROPEAN "LOCK-STEP"

Issues in Europe may take on outsized influence next week as the U.S. earnings season draws to a close, with Tiffany & Co (TIF.N) and Applied Materials (AMAT.O) among the few S&P 500 companies on tap to report.

Earnings, while often overshadowed by macroeconomic themes, have largely come in stronger than expected, giving investors at least one reason for optimism.

Next week, investors will have plenty of U.S. economic indicators to watch, including the release of data on new home sales data, durable goods orders, consumer sentiment and gross domestic product. Should the data follow the recent trend of weak reports, which have contributed to the growing sense that growth will be muted, it could cause further selling.

"There's still something of a sense that this is just a weak patch in the economy, but prolonged weak data would point more definitely to a double dip," said Marc Scudillo, managing officer at EisnerAmper in New York. "There's a good floor to the S&P 500 at 1,100 right now. If we go under that, there's room to move even further to the downside."

While U.S. growth concerns remain a primary focus for investors, the issues in Europe are seen as the primary driver of the U.S. stock market in the near-term.

On Tuesday, markets fell as the leaders of France and Germany failed to discuss boosting the size of the euro zone's rescue fund or the sale of euro bonds, though they detailed closer euro-zone integration. Many investors believe more aggressive policies are needed to restore stability to the area.

"What I'm seeing right now is a basically a crisis of confidence, more so than an economic crisis or financial crisis necessarily at this stage," said Natalie Trunow, chief investment officer of equities at Calvert Investment Management in Bethesda, Maryland.

Trunow, who helps oversee about $14.8 billion in assets, cited "the inability by policy-makers to come to a good path" as the reason for the uncertainty.

Morgan Keegan's Gibbs said that the endgame in Europe was that "if confidence doesn't return, we'll continue to see the S&P essentially moving in lock-step with European markets."
