RIM sticking with consumer goods, just 'refocusing' on enterprise

Some people got the wrong idea yesterday when RIM's new CEO Thorsten Heins said the company was refocusing on the enterprise market and would stop trying to be "all things to all people." Many took the post-earnings call comment to mean that RIM would be exiting the consumer market, an assumption that didn't seem like much of a stretch considering its failure to capture the imagination of users outside the office place. Things weren't made any better when Heins seemingly left the door open for the manufacturer to leave the hardware business entirely. However, in a statement, managing director of global sales and regional marketing Patrick Spence clarified that "the claim that RIM has said it will withdraw from the consumer market is wholly misleading." He continued to explain that, "whilst we announced plans to refocus our efforts on our core strengths, and on our enterprise customer base, we were very explicit that we will continue to build on our strengths to go after targeted consumer segments." In particular there still seems to be hope that BBM can become a staple in the lives of young trend setters, but it'll probably need some help from cross platform clients to do so.

Update: Just in case there was any doubt RIM has posted a clarification on its blog saying in no uncertain terms that the consumer market is still a target. MILAN (AP) ? Hospital pharmacists are threatening to cut Italians off from their Viagra unless the government amends its plans to reform professions that have high entry barriers.

Union official Loredana Vasselli said pharmacists decided to focus the protest on Viagra because it is a sought-after drug whose absence "does not put patients' health at risk."

Pharmacists will stage a series of labor actions during April, culminating with the so-called "Viagra strike" if their complaints are not redressed.

Unless it's an emergency, drivers who talk on their cellphones -- even hands-free -- in Chapel Hill, North Carolina will face a $25 fine, but the first town in the U.S. to impose this kind of ban may be overstepping its authority with the state.

On Monday, the town council voted 5-4 in favor of an ordinance that prohibits any kind of cellphone use while driving.

NBC17 reported that this ruling, however, may exceed the town's jurisdiction.?The state's assistant Attorney General Jess D. Mekeel wrote in a letter that the state "has preemptive authority to regulate the use of mobile phones by motorists within the state of North Carolina. It is my opinion that an ordinance by the Town of Chapel Hill regulating motorists? use of cell phones is preempted by State law and, therefore, unenforceable."

Chapel Hill's town attorney disagrees with that interpretation, NBC17 said.

I've reached out to the town council and mayor, and will update if and when we hear from them. I called Ed Harrison, the council member who cast the deciding vote (and who was absent during the first stalemate vote earlier this month). He declined to comment.

Chapel Hill has a population of more than 51,000 and covers 21.1 square miles, with the University of North Carolina at Chapel Hill as one of its major employers.

The ban would begin June 1 and has already ignited a local firestorm. Some took their elected officials to task via emails, which are available at the council's website. Here's one that objects to the decision:

Dear all,
When I heard that the town council voted 5-4, I was just shocked and appalled at the decision. The ruling doesn't make sense at many levels. I understand and I think we all agree that texting, putting on make-up, shaving, stuffing a big sandwich in your mouth (dashboard dining), talking on a hand-held cellphone, messing with a radio or a GPS device, while driving are all distracting. Interestingly, some of these will still be legal come June 1 in the great town of Chapel Hill. If you truly believed that hands-free cellphone is so dangerous, why would talking to your parent, spouse, or children (the exceptions you made) make it less dangerous. Or how about talking to your fellow passengers? Can we all just use some common sense and repeal this ruling.
I consider myself a liberal and progressive but this ruling went too far. All I could think of was Jessie Helms comment about putting a fence around our town. You just made us look like extreme and fringe lunatics. Thank you for that.

Those who opposed the ban also pointed to the difficulty of enforcing the ban on the town's roads and the cost of such vigilance.?

And then, there were messages like this, in support of the ban:

I am well aware of the ?studies that show that the use of cell phones (hand-held AND hands-free) is as detrimental to good driving as driving drunk, but many people are not. It's not just texting that's a problem --- even conversations on a hands-free device are distracting. I avoid driving when the bars close because I try to limit my encounters with drunk ?drivers, but I cannot do the same with cell-phone using drivers. They are everywhere.
Even though this ban might be difficult to enforce, the same was probably true of the seat belt law when it was new. I know people who now wear their seat belts specifically because of the existence of the law. Please do the same for cell phone use, and make the roads safer for all of us.

For those who support the ordinance, one clause will probably rankle them. It won't be considered a primary offense, in that drivers won't be pulled over just for talking on their phones -- it could be added on if the driver is stopped for another offense.

Spike Lee wasn't the first to retweet the erroneous address on Twitter blindly accepted by many as that of George Zimmerman, the man who fatally shot 17-year-old Trayvon Martin last month. But the filmmaker's message -- sent last week to his 240,000 Twitter followers -- was the most viral.

Elaine McClain, 70, the owner of the misidentified house in Sanford, Florida, and her husband David McClain, 72, tell news outlets they're now "living in fear." The address spread on Twitter, accompanied by threats of violence, and the couple are now staying at a hotel "to avoid the spotlight and possible danger," reports the Orlando Sentinel.

Oh, and Mrs. McClain? She reportedly has a heart condition. Awesome.

So how did this happen? As The Smoking Gun breaks it down, Marcus Davonne Higgins, the 33-year-old Los Angeles man behind the bad address, confused McClain's son, George W. Zimmerman, who once lived at the address, with George Michael Zimmerman, the man who killed Martin. Higgins then blasted the address to the Twitter accounts of Will Smith, 50 Cent, LeBron James, as well as to Lee. But Lee is the only one who retweeted it.

The great big "WRONG!" here isn't the bad address, or whether Lee should research the info before he retweets. And as regrettable as it is, Lee can't be held accountable for giving conservative pundit Michelle Malkin more fuel for Trayvon Martin race baiting on her Twitter "news" site Twitchy. Posting on Twitter, Baldwin gave out the handle of the alleged?harasser, @scarfacemadam, whom he said "has entered the twitter-verse ONLY to harass my girlfriend" in a way "that is borderline threatening." He asked users to "go to her address and read just a few of her posts, and give her your notice of her behavior."

While many of the Twitter attacks against?@scarfacemadam didn't?compare to the jillions of ugly death threats tweeted by Justin Bieber fans on any given day, they weren't pretty. As we noted then,?if the troll harassing his GF really is as bad as he claimed, then it's way to fuel a psycho stalker, Alec Baldwin! Conversely, if the troll was just your run-of-the-mill Internet jerk (with or without diagnosable mental issues), then Baldwin just sent thousands of people in that troll's direction.?

As it turned out, the kerfuffle faded fast soon after the @scarfacemadam account went dormant. It could've been worse. It wasn't.

In Lee's case however, helping chum Twitter could've resulted in violence -- against an innocent elderly couple or a man yet to face the justice system -? as well as a jail sentence for any Lee fans who took his retweet to heart. ?

You've probably had the feeling. Your running shoes are pounding the pavement?then suddenly your pain fades away, and you're feeling euphoric. The runner's high. But that biological perk may be limited to mammals that evolved for endurance exercise?like us. So says a study in the Journal of Experimental Biology. [David A. Raichlen et al, Wired to run: exercise-induced endocannabinoid signaling in humans and cursorial mammals with implications for the ?runner?s high?]

Researchers had humans and dogs?both natural-born runners?jog a half hour on a treadmill. Then they sampled their blood for endocannabinoids, some of the compounds thought to trigger the runner's high. As expected, humans and dogs had much higher levels after the run. But when ferrets?a sedentary species?took the same 30-minute trot, they had no spike in those feel-good molecules.

The authors say that's because long-distance running could have helped our hunter-gatherer ancestors find more food?thus increasing their reproductive success. And they speculate that natural selection may have linked up a feel-good reward to that beneficial behavior. These days of course, this ancient trait won't help us find extra calories?but it may encourage us to run 'em off.
